The Management Board of Grupa LOTOS S.A. hereby reports that it has been notified today by ING Otwarty Fundusz Emerytalny that following a purchase of Grupa LOTOS S.A. shares in transactions on the Warsaw Stock Exchange, settled on November 19th 2009, ING Otwarty Fundusz Emerytalny (“the Fund”) became the holder of the Company shares conferring the right to over 5% of the total vote at the General Shareholders Meeting of Grupa LOTOS S.A.

Prior to the change in its shareholding, the Fund held 6,464,479 (six million, four hundred and sixty-four thousand, four hundred and seventy-nine) Grupa LOTOS S.A. shares, representing 4.98% of the Company’s share capital, and was entitled to 6,464,479 votes, or 4.98% of the total vote, at the General Shareholders Meeting.

On November 23rd 2009, 6,524,479 (six million, five hundred and twenty-four thousand, four hundred and seventy-nine) Grupa LOTOS S.A. shares were recorded in the Fund’s securities account, representing 5.02% of the Company’s share capital and conferring the right to 6,524,479 votes, or 5.02% of the total vote, at the General Shareholders Meeting of Grupa LOTOS S.A.
